What is a Deferred Sales Trust

The Deferred Sales Trust or DST is a legal contract between you (the note holder) and a third-party trust. If you are like the more than 2,000 other DST Trust holders, you want to reduce and defer capital gain taxes on the sale of your highly appreciated asset.
When you sell a primary residence, investment property, or business to a Deferred Sales Trust, this trust provides a contractual promise to pay you a predetermined amount over time in the form of an installment sale note or promissory note.
The Deferred Sales Trust gives you the ability to control your capital gain and state income tax exposure, investment returns, and installment payments made from the trust.

Why Do I Need a Trustee?

In order to legally defer capital gains taxes on the sale of a primary residence, investment property, or business, the taxpayer must never take constructive receipt or control of any proceeds from the sale of the asset. 
A Deferred Sales Trust is one vehicle that can be used to defer capital gain taxes, but the trust must be managed by a disinterested third party – the Trustee. This trustee cannot be a relative, or have a business or personal relationship with the taxpayer.

What Does A Trustee Do?

A trustee is an individual or company, completely independent, performing the fiduciary duty of managing a trust. 
The Deferred Sales Trust must employ a trustee that is truly independent. This independent trustee is responsible for managing the trust according to the laws that govern trusts, according to the installment contract, and according to the investor “note holder” risk tolerance and investment objectives.
